On Friday, June 24, 2022, the PEI Potato Board filed an Application for a Judicial Review in the Federal Court against the Canadian Food Inspection Agency (CFIA) and the Minister of Agriculture and Agri-food.
The Application asks the Federal Court to set aside a number of ongoing government decisions that, since November of 2021, have prohibited the movement of PEI seed potatoes to other Canadian markets and to the United States, including aMinisterial Order declaring the entire province “infested” with potato wart.
The Application alleges that these decisions have restricted the movement of all PEI seed potatoes, including those from fields with no relation to potato wart detections, without adequate scientific or rational justification.
The Board continues to demand answers and accountability from the government. These decisions have caused catastrophic damage to PEI’s seed industry.
On March 23, 2023, the Federal Court heard the Board’s Application in Charlottetown. Legal counsel Duncan Boswell, Gowling WLG says, “The judge reserved his decision, so we simply await the result.”
